Australian Taxation Office Class Ruling on Demerger

ChemGenex Pharmaceuticals Limited (ASX:CXS and NASDAQ:CXSP) advises that the Australian Taxation Office (ATO) has provided a Class Ruling on the demerger of Autogen Research Pty Ltd by ChemGenex Pharmaceuticals Limited, which occurred on 13 December 2007.

The Class Ruling is available on the ATO website (www.ato.gov.au) under Class Ruling reference CR 2008/31 Income tax: demerger of Autogen Research Pty Ltd by ChemGenex Pharmaceuticals Ltd.

Shareholders are advised that the ruling will only apply to certain shareholders for the income tax year ending June 30, 2008. Shareholders should seek independent advice from their taxation adviser to determine how this ruling will effect their income tax position.
